Following the publication of the government’s Education White Paper “Education Excellence Everywhere”, School, Academy and Local Authority responsibilities, in relation to education, are set to evolve further. There will be an even greater requirement for schools and academies to ensure their pupils are achieving ever increasing expectations and for LA’s to “promote school attendance and tackle persistent absence”.

- Devise and implement strategies to support and challenge pupils and their parents with poor attendance;

- Design, train and deliver services which are able to hold schools and academies to account for the attendance of their pupils
- Conduct thorough and informed investigations in compliance with the Police and Criminal Evidence Act 1986 and Criminal Procedure and Investigations Act 1996.
- Initiate court/non-court disposals in compliance with the Code for Crown Prosecutors and Criminal Procedure Rules.

Did you know….
- Local authorities must conduct all investigations in accordance with the Police and Criminal Evidence (PACE) Act 1984 and only Local authorities have the power to prosecute parents who fail  to ensure their child’s regular attendance at a school (section 444 of the Education Act 1996)
- This power may not be “contracted out” or delegated to any other body or organisation by a Local Authority (as stipulated by the Contracting Out (Local Education Authority Functions) (England) Order 2002).
- PACE is only a small part of the investigation process and in relation to our work, governs only the interviewing of suspects by written/audio recorded means. Â All criminal investigations (including investigations in relation to poor attendance) must comply with the Criminal Procedure and Investigations Act 1996.
