Did you know….

1. Local authorities must conduct all investigations in accordance with the Police and Criminal Evidence (PACE) Act 1984 and only Local authorities have the power to prosecute parents who fail  to ensure their child’s regular attendance at a school (section 444 of the Education Act 1996)
2. This power may not be “contracted out” or delegated to any other body or organisation by a Local Authority (as stipulated by the Contracting Out (Local Education Authority Functions) (England) Order 2002).
3. PACE is only a small part of the investigation process and in relation to our work, governs only the interviewing of suspects by written/audio recorded means.  All criminal investigations (including investigations in relation to poor attendance) must comply with the Criminal Procedure and Investigations Act 1996.
